Re: Arbitration: IAAF Says Young Improperly Cleared

Interesting indeed, Rogge says he will accept any punishment(or lack of) the IAAF decides to mete out, which indicates his bias's against USATF, who cleared Young and then upheld by the CAS.

If these folks are correct, how can the current US group remain employed? Isn't it time to make a change?

Like so many, you seem to have the impression that Masback and other staff members have something to do with the hearings that decide how to proceed on drug cases. They don't.

          Garry,

Didn't you know that Craig is the Devil and is responsible for all the evils in T&F? He actually made Jerome take the drugs after buying them for him.

Ooops, sorry, wrong message board. LOL!!

You gotta love the statement without referring to the exact findings of impropriety that they used to arrive at them. This is no better than USATF closing the file. To say its wrong without a statement of factual reasoning is dirty pool so they can go to the CAS and overturn what the CAS already decided.

            Freaking ridiculous.

GH and MJD make me understand how they can say in the same breathe that whatever ruling from CAS is binding, while reopening a CAS ruling from Jan. 2003?
GH when will you blow this thing wide open for the international community and state the facts. The Olympic team is a USOC sanctioned team, all members are cleared by USOC, NOT the USATF. This matter was taken to arbitration 2 years ago and CAS cited that USATF did what was right at the time of this infraction, therefore the case is closed and we move on!
But here we stand with the acronym gang coming after the USA again, on the same issue, with the same set of facts! Double jeopardy is what we call it here in the US.
And I am sorry, but what in the hell was USATF doing apologizing? There is a time to be diplomatic and then there is a time to defend yourself, just ask President Bush!
I am tired of this witch hunt by IAAF and WADA, and I am tired of my federation and country taking the blame for X files, and conspiracy theories!

Not me-MJR. And I think he agrees with you. gh is just presenting facts. I don't think the CAS has actually ruled on this issue yet. I think they just ruled on whether the USATF could keep it a secret. It's no longer a secret. Various groups are arguing about it so isn't this exactly what the CAS is for?

MJD sorry about the mix up...
But you are saying that the previous ruling was about USATF confidentiality rules?
My understanding is that they ruled USATF did no wrong with the case and everything was on the up and up. Does that not imply that they reviewed the case itself?

M understanding was that they din't review the underlying case but someone out there must know the answer to that question.

Re: Arbitration: IAAF Says Young Improperly Cleared

I shouldn't comment without being able to quote chapter and verse, but I know that what has happened is that the "rules changed."

CAS (international arbitration) sided with USATF in that given the way the lines of communication ran between USATF and IAAF, USATF was not obliged to provide IAAF with any further information regards the cases of Young and (13?) other cases in the few years leading up to Sydney.

Where I'm not 100% off the top of head (which is all you get at the moment), is in the wake of Young's name being made public, which has been interprted as "different situation." USOC then said that it needed complete data on the case (which I believe they originally had, by the by). USATF continued to say no, but when USOC said that decertification of the federation was the next step, USATF blinked first.

And now that IAAF has seen the complete files on the Young case, they say that he was improperly cleared, so CAS will now hear his case in detail.

Based on everything that I have read, that is my understanding of the situation.

Just read in the LA Times that Young has sued USATF and the USOC for unspecified damages. Pathetic. I hope he gets booed all over Europe this summer.

Amd some say that the legal lobby isn't a "special interest":

"Jerome Young, whose positive doping case sparked international controversy, has filed a lawsuit against the U.S. Olympic Committee (USOC) and USA Track & Field (USATF), said USATF spokeswoman Jill Geer."
